Severtson Custom Large Format Electric/Studio Screens

TERMS AND CONDITIONS

Definitions: “Severtson” shall mean Severtson® Corp. 216 S. Alma School Rd., Suite 3, Mesa, AZ 85210.  “Owner” shall mean the original party listed above as Owner’s Name who is the original owner of a Severtson Projection Screen.

Severtson warrants the Severtson Custom Large Format Electric/Studio Screen Projection Screen referenced above to be free from manufacturing defects which would prevent the product from performing as advertised by Severtson for one (1) year from the date of original purchase.  This warranty is for the sole benefit of owner described above (“Owner”) and is not assignable or transferrable.

Should the Severtson Projection Screen be deemed defective by Severtson, as described above, Severtson shall, at its sole option, replace the defective screen or any of its components, or compensate the Owner for the full purchase price of the screen.  This warranty only covers the monetary value of the screen itself and does not cover the costs of shipping replacement screens or the labor and installation costs associated with installing a new screen.  Any replacement or refunds shall be Owner’s SOLE AND EXCLUSIVE REMEDY against Severtson.

Severtson shall have no obligation based upon the following exclusions under this warranty:

1. Damage caused to the screen during installation;
2. Screens not installed by professional Audio Video contractors;
3. Damage by natural disasters, including but not limited to floods, hurricanes, tornadoes, earthquakes or similar acts of god or natural causes;
4. Damage caused by willful or negligent acts, fire, vandalism, or other misuse;
5. Damage by use of materials not furnished by Severtson;
6. Owner fails to use reasonable care in maintaining the screen;
7. Damage by structural failure of the surrounding building;
8. Alterations or repairs made to the screen;
9. Uninstalling and reinstalling the screen;

Claim Procedure:

Severtson shall have no obligation under this warranty unless Owner shall have promptly notified Severtson in writing along with the attached Proof of Purchase to Severtson by registered or certified mail.  Direct all claims to Severtson Corp. 216 S. Alma School Rd., Suite 3, Mesa, AZ 85210, ATTN: Warranty Department.  Any claim shall provide a copy of warranty and detailed information regarding the alleged defect, including photographs of the defect.  Severtson must receive such notice within ten (10) days after discovery of the claimed defect.

Owner shall provide Severtson, and its agents and employees, free, safe and reasonable access to the screen to assess the condition of the screen during normal business hours during the term of the warranty.  Owner shall be responsible for all costs related to safe and reasonable access to investigate claim.

Severtson’s good-faith determination of the source of the damage or alleged defects shall be exclusive and binding to owner.  Severtson’s failure at any time to enforce any of the terms and conditions of this warranty shall not be construed as a waiver of such provisions.  Severtson reserves the right to discontinue or modify any of its products and shall not be liable to Owner as a result of any such discontinuance or modification.

THIS WARRANTY SUPERCEDES AND IS IN LIEU OF ALL OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRNATIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  THIS WARRANTY SHALL BE OWNER’S EXCLUSIVE REMEDY AGAINST SEVERTSON OR ITS AFFILIATES, AND NEITHER SEVERTSON NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES.  SEVERTSON’S AGENTS HAVE NO AUTHORITY TO GIVE WARRANTIES BEYOND THOSE PROVIDED IN THIS WARRANTY.  ALL RIGHTS AND DUTIES ARISING UNDER THIS WARRANTY SHALL BE GOVERNED BY ARIZONA LAW.

Warranty presented and determined as incomplete or inaccurate shall be considered null and void.
